MOBIFONE CUSTOMER INFORMATION PROTECTION POLICY

Legal basis:

  • Pursuant to the Law on Telecommunications No. 24/2023/QH15 dated November 24, 2023, promulgated by the National Assembly;

  • Pursuant to the Law on Personal Data Protection No. 91/2025/QH15 dated June 26, 2025, promulgated by the National Assembly;

  • Pursuant to Decree No. 163/2024/ND-CP issued by the Government on December 24, 2024, detailing certain articles and measures for implementation of the Law on Telecommunications;

  • Pursuant to Decree No. 356/2025/ND-CP issued by the Government on December 31, 2025, detailing certain articles and measures for implementation of the Law on Personal Data Protection;

  • Pursuant to Circular No. 08/2026/TT-BKHCN dated March 31, 2026, providing guidance on subscriber information authentication for terrestrial mobile telecommunications services, issued by the Ministry of Science and Technology.

The Customer Information Protection Policy of MobiFone Telecommunications Corporation (hereinafter referred to as the “Policy”) is intended to help customers better understand the purposes and scope of information for which we process personal data, as well as the measures we apply to protect customers’ information and rights in relation to such activities in accordance with Vietnamese laws on customer information protection.

This Policy also provides recommendations to help customers raise their awareness of customer information protection.

This Policy constitutes the general terms and conditions applicable to all activities of providing products and services by MobiFone and applies across all platforms that interact with individual customers in the digital environment.

MobiFone is responsible for fully and publicly providing this Policy so that customers are informed before entering into a contract or transaction and for obtaining customers’ consent to this Policy before carrying out any customer information processing activities in accordance with applicable laws.

By checking the “Customer Consent” box on websites/applications providing MobiFone services where this Policy is publicly posted; on other information pages provided by MobiFone from time to time; or by entering into a contract with MobiFone that references and attaches this Policy, the customer confirms that they have carefully read, fully understood, and agreed to all contents of this Policy.


Article 1. Definitions and Abbreviations

For the purposes of this Policy, the following terms shall be understood and interpreted as follows:

1. MobiFone Telecommunications Corporation (hereinafter abbreviated as “MobiFone”) is an entity under the Ministry of Public Security, comprising:

a) MobiFone (a Level I enterprise).

b) Subsidiaries of MobiFone (Level II enterprises).

c) Subsidiaries of Level II enterprises.

d) Affiliates of MobiFone.

e) Enterprises within MobiFone that have legal person status; their own capital and assets; and the right to possess and dispose of their assets in accordance with the law and common agreements among enterprises within MobiFone.

2. Customer means:

a) An individual or the lawful representative of an individual who uses and/or is interested in MobiFone’s products and services.

b) An individual or the lawful representative of an individual who has accessed and/or registered an account on websites/applications providing MobiFone services.

3. MobiFone’s products and services include:

a) Terrestrial mobile telecommunications services (voice services, messaging services, and Internet access services).

b) Terrestrial fixed telecommunications services (voice services and Internet access services).

c) Pay television services.

d) Other products and services provided by MobiFone to customers in accordance with applicable laws.

4. Customer Information includes:

a) Customers’ personal data as prescribed by laws on personal data protection and other applicable laws, guidance, amendments, and adjustments from time to time.

b) Information regarding customers’ purchase and use of products, goods, and services and other information related to transactions between customers and MobiFone.


Article 2. Processing of Customer Information

1. MobiFone processes customer information in the following circumstances:

a) When a customer or the customer’s lawful representative contacts MobiFone to request consultation regarding MobiFone’s products and services or expresses an interest in MobiFone’s products and services.

b) When a customer trials, enters into a contract for, registers for, or uses MobiFone’s products and services.

c) When a customer accesses and/or registers an account on websites/applications providing MobiFone services.

d) When a customer agrees to provide customer information to MobiFone through publicly available sources such as websites/applications providing services; meetings, events, seminars, conferences, social networks, or dialogue and discussion programs organized, sponsored, or attended by MobiFone and/or through cookies recorded on websites/applications providing MobiFone services.

e) When a customer of an organization or enterprise permits such organization or enterprise to share the customer’s customer information with MobiFone.

f) When the customer is a customer of an organization or enterprise in which MobiFone makes capital contributions or purchases shares; or is a customer of an organization or enterprise that cooperates with MobiFone in providing products and services.

g) When requested by competent state authorities.

h) When MobiFone performs activities for the purposes of processing customer information specified in Article 3 of this Policy.

i) Other cases as prescribed by law.

2. Customers’ personal data processed by MobiFone (hereinafter referred to as “Personal Data”) includes:

2.1. List of Basic Personal Data

Basic personal data includes:

a) Full name, middle name and birth name, other names (if any).

b) Date, month, and year of birth; date, month, and year of death or declaration of disappearance.

c) Gender.

d) Place of birth, place of birth registration, place of permanent residence registration, place of temporary residence registration, current place of residence, hometown, contact address.

e) Nationality.

f) Personal images.

g) Telephone number, personal identification number, passport number, driving license number, vehicle license plate number.

h) Marital status.

i) Information about family relationships (parents, children, spouse).

j) Information about an individual’s digital account.

k) Other information associated with a specific individual or helping to identify a specific individual that is not included in the category of sensitive personal data (Article 4 of Decree No. 356/2025/ND-CP dated December 31, 2025).

2.2. List of Sensitive Personal Data

Sensitive personal data includes:

a) Data revealing racial or ethnic origin.

b) Political opinions, religion, and beliefs.

c) Information concerning private life, personal secrets, and family secrets.

d) Health status.

e) Biometric data and genetic characteristics.

f) Data revealing an individual’s sex life or sexual orientation.

g) Data concerning crimes and violations of law collected and stored by law enforcement authorities.

h) An individual’s location determined through location services.

i) Usernames and passwords for accessing an individual’s electronic identification account; images of identity cards, citizen identity cards, and identity cards.

j) Usernames and passwords for accessing bank accounts; bank card information; bank account transaction history; financial and credit information and information regarding financial, securities, and insurance activities and transaction history of customers at credit institutions, foreign bank branches, payment intermediary service providers, securities and insurance organizations, and other legally authorized organizations.

k) Data tracking behavior and activities involving the use of telecommunications services, social networks, online communication services, and other services in cyberspace.

l) Other personal data that the law requires to be kept confidential or subject to strict security measures.

3. The data subject provides personal data to agencies, organizations, and individuals in accordance with the law or under agreements with such agencies, organizations, and individuals.

In this regard, mandatory customer information means customer information that MobiFone is required to collect from customers by law or information that MobiFone is required to use to provide part or all of MobiFone’s products and services at the customer’s request.

Optional customer information means customer information collected by MobiFone to improve customer experience, predict consumer behavior, or conduct research on the telecommunications services market. Failure to provide optional customer information shall not affect the provision of MobiFone’s products and services requested by the customer.

If mandatory customer information is not provided as requested by MobiFone, the customer may be unable to use part or all of MobiFone’s products and services.

In such case, MobiFone may refuse to provide products and services to the customer without being liable for any compensation and/or contractual penalty (except where such refusal results from MobiFone’s fault or otherwise provided by law).

4. MobiFone may process customer information itself or authorize or engage a third party to process customer information, provided that such processing ensures the safety and security of customer information in accordance with applicable laws.

Where MobiFone authorizes or engages a third party to process customer information, the customer’s consent must be obtained.

The authorization or engagement of a third party must be made in writing, clearly specifying the scope and responsibilities of each party in protecting customer information in accordance with applicable laws.

Where a customer conducts a transaction through a third party, such third party is responsible for protecting customer information in accordance with applicable laws.


Article 3. Purposes of Processing Customer Information

1. MobiFone may process customer information in the following cases (“Mandatory Purposes”):

a) Provision of telecommunications and television services at the customer’s request and only within the scope of information to which the customer has consented

Including:

  • Terrestrial mobile telecommunications services (voice services, messaging services, and Internet access services).

  • Terrestrial fixed telecommunications services (voice services and Internet access services).

  • Pay television services.

  • Other products and services provided by MobiFone to customers in accordance with applicable laws.

  • Verification of the accuracy and completeness of information provided by customers in accordance with applicable laws; identification or authentication of customers’ identities and implementation of customer authentication procedures and requirements.

  • Processing registration for the use of MobiFone’s products and services.

  • Assessment of customer applications and eligibility for the use of MobiFone’s products and services. MobiFone may use scoring methods, assign credit thresholds, and review customers’ historical use of MobiFone’s products and services to assess and manage credit risks and ensure the ability to fulfill payment obligations and other related obligations throughout the provision of MobiFone’s products and services to customers.

  • Exercising customers’ rights relating to customer information in accordance with applicable laws and agreements between customers and MobiFone.

  • Notifying customers of network impact plans relating to MobiFone’s products and services.

  • Managing customer accounts and customer loyalty programs.

  • Receiving and resolving customer requests, complaints, and claims; sending notifications to customers to survey customer satisfaction regarding the quality of products and services and the processes for resolving requests, complaints, and claims carried out by MobiFone.

  • Contacting customers to provide consultation, exchange information, resolve requests and complaints, and deliver invoices, statements, reports, or other documents relating to MobiFone’s products and services through various channels (e.g., email, chat, call center), as well as responding to customer requests.

  • Evaluating the production and business performance of units; operating internal management systems, performance evaluation systems, and systems for monitoring production and business activities.

  • Preparing documents for bidding invitations or participation in bids; preparing reports, statistics, and internal data analyses for research, development, management, measurement, provision, and improvement of products, goods, and services, as well as management of MobiFone’s business operations.

  • Assessing customers’ ability to purchase and use MobiFone’s products, goods, and services through telecommunications customer scoring to provide the best possible products, goods, and services to customers.

  • Providing information requested by customers or which MobiFone determines may be useful to customers, including information about MobiFone’s products and services in accordance with applicable laws.

  • Improving technology and the interfaces of websites/applications providing services to optimize customer experience.

b) Performance of obligations under applicable laws

Pursuant to Point c, Clause 3, Article 18 of the 2023 Law on Protection of Consumer Rights, including:

  • Preparing reports as required by telecommunications and television laws or upon written request from competent state management authorities.

  • In emergencies requiring immediate processing of relevant customer information to protect the life or health of the data subject or another person, provided that such processing complies with applicable laws.

  • Public disclosure of customer information as prescribed by law; compliance with obligations of enterprises providing telecommunications and television services as prescribed by law.

  • Processing of data by competent state authorities in cases of national defense or national security emergencies, public order and safety emergencies, major disasters, dangerous epidemics; where there is a threat to national security or defense that has not reached the level requiring declaration of a state of emergency; for prevention and combat of riots, terrorism, crimes, and violations of law as prescribed by law.

  • Performing contractual obligations of the data subject with relevant agencies, organizations, and individuals in accordance with applicable laws.

  • Serving activities of state agencies as prescribed by specialized laws.

2. Except for the cases specified in Article 3.1, MobiFone must notify and obtain the customer’s consent before processing the customer’s customer information for the purposes listed below (hereinafter referred to as “Optional Purposes”).

Customer information collected, updated, or supplemented must be appropriate and limited to the scope and purposes necessary for processing as prescribed in this Policy.

a) Business purposes

Business purposes involving data analytics services, authentication services, identification services, advertising services, marketing, market research, opinion polling, and brokerage.

For marketing services, the methods, forms, and frequency of product introduction shall be implemented in accordance with laws on personal data protection.

b) Organization of advertising and product, goods, and service introduction programs

Organizing advertising and product, goods, and service introduction programs and carrying out trade promotion activities for products, goods, and services provided by MobiFone.

This includes activities using customer information to advertise and market to customers regarding promotional programs, research, surveys, news, updates, events, prize-winning contests, distribution of relevant rewards, advertisements, and related content concerning MobiFone’s products and services where the customer has consented.

If customers no longer wish to receive emails, messages, and/or periodic newsletters for MobiFone’s advertising and marketing purposes, with the frequency depending on MobiFone’s policies from time to time and in accordance with applicable laws, customers may opt out through the methods instructed by MobiFone via channels and means such as messages, calls, checkboxes on websites/applications providing services, or by contacting MobiFone’s customer care center.

3. MobiFone does not conduct the sale or purchase of customer information in any form.


Article 4. Methods of Processing Customer Information

MobiFone applies one or more activities involving customer information, including: collection, authentication, analysis, aggregation, encryption, decryption, modification, deletion, destruction, de-identification, provision, disclosure, transfer of personal data, and other activities affecting personal data.


Article 5. Commencement and Termination of Data Processing

1. Commencement of data processing:

From the time the purposes specified in Article 3 of this Policy arise.

2. Termination of data processing:

MobiFone shall cease processing customer information when the purposes specified in this Policy have been fulfilled, except where otherwise provided by law, where the customer withdraws consent to the processing of customer information, or where requested in writing by a competent state authority.


Article 6. Scope of Use of Customer Information

1. MobiFone may share customers’ customer information with the following organizations and individuals to perform the purposes specified in this Policy (“Mandatory Scope of Use”), specifically:

a) Sharing information with MobiFone (Level I enterprise), subsidiaries of MobiFone (Level II enterprises), subsidiaries of Level II enterprises, affiliates of MobiFone, and enterprises within MobiFone that have legal person status, their own capital and assets, and the right to possess and dispose of their assets in accordance with the law and common agreements among enterprises within MobiFone.

b) Sharing information with third-party service providers of MobiFone or partners under business cooperation agreements for the development of MobiFone’s products and services, where the parties have entered into a written agreement under which the third party is responsible for protecting customer information.

MobiFone uses and/or cooperates with other companies and individuals to perform certain activities and programs, such as advertising programs, customer promotions, market research, product analysis and development, strategic consulting, and fee collection services.

Such third-party service providers and/or partners may access, collect, use, and process customers’ customer information within the scope to which customers have consented and MobiFone has authorized for the performance of their functions, and must comply with laws on customer information protection in their capacity as data processors.

The parties must have a written document/agreement on customer information processing clearly specifying the scope, purposes, types of customer information shared, rights and obligations of the parties, and responsibilities of the customer information processor for protecting customer information.

c) Sharing information with telecommunications enterprises that have a written agreement with Party B regarding the exchange and provision of telecommunications subscriber information and information concerning the use of telecommunications services by service users for pricing and invoicing purposes.

d) Providing telecommunications subscriber information concerning subscribers who evade their payment obligations for telecommunications services in accordance with regulations of the former Ministry of Information and Communications, now the Ministry of Science and Technology.

e) When requested by competent state authorities in accordance with applicable laws.

3. In addition to the purposes specified in Article 6.1 of this Policy, sharing customer information with any other third party requires the customer’s consent (“Optional Scope of Use”).


Article 7. Customer Rights

1. Right to be informed about personal data processing activities

Customers have the right to be informed about the processing of their customer information, except where otherwise provided by law.

2. Right to consent or refuse consent and request withdrawal of consent to personal data processing

Customers have the right to consent or refuse to consent to the terms and conditions of this Policy through the methods instructed by MobiFone via channels and means such as SMS messages, calls, checkboxes on websites/applications providing services, or by contacting MobiFone’s customer care center in accordance with applicable laws.

MobiFone shall only process customer information after obtaining the customer’s consent.

Customers have the right to request withdrawal of consent when they have concerns regarding the scope or purposes of personal data processing or the accuracy of the personal data for which they have permitted processing, by submitting a written request, including an electronic form or a verifiable format, to MobiFone, except where otherwise provided by law.

Withdrawal of consent shall not affect the lawfulness of processing carried out based on the customer’s consent before such withdrawal.

3. Right to access, amend, or request amendment of personal data

Customers have the right to request MobiFone to access MobiFone’s service-providing applications/websites and/or directly contact MobiFone to view and propose amendments to customer information, except where otherwise provided by law.

4. Right to request provision, deletion, restriction of processing of personal data; right to object to personal data processing

a) Customers have the right to request deletion of their personal data by submitting a written request to MobiFone, except where otherwise provided by law.

b) Customers have the right to request restriction of processing of their personal data by submitting a written request to MobiFone where there are concerns, except where otherwise provided by law.

c) Customers have the right to request MobiFone to provide their personal data for review and adjustment to ensure consistency with their current personal data.

d) Customers have the right to submit a request to MobiFone to object to the processing of their personal data in accordance with applicable laws.

5. Personal data shall be deleted or destroyed in the following cases:

a) The customer makes a request and accepts the risks and potential damages that may arise to the customer.

b) The purposes of personal data processing have been fulfilled.

c) The applicable data retention period has expired in accordance with the law from time to time.

d) Pursuant to a decision of a competent state authority.

e) Pursuant to an agreement between the customer and MobiFone.

f) Other cases as prescribed by law.

6. Right to complain, denounce, initiate legal proceedings, and request compensation for damages in accordance with applicable laws

a) Customers have the right to file complaints, denunciations, or initiate legal proceedings in accordance with applicable laws.

b) Customers have the right to request compensation for actual damages in accordance with applicable laws if MobiFone violates regulations on the protection of their personal data, except where otherwise agreed by the parties or provided by law.

7. The right to request competent authorities or agencies, organizations, and individuals involved in the processing of customers’ personal data to implement measures and solutions to protect customers’ personal data in accordance with applicable laws.


Article 8. Customer Obligations

Customers are responsible for protecting their customer information as follows:

a) Proactively implement measures to protect, manage, and safely use personal accounts and technological devices (including smartphones, computers, tablets, and laptops) by logging out of accounts after use, setting a strong password, and keeping login information and passwords confidential.

The above measures for protecting and safely managing accounts and mobile devices help prevent unauthorized access to customers’ accounts.

MobiFone shall be excluded from liability for damages suffered by customers in cases where customers disclose/lose or have their passwords stolen, resulting in unauthorized access to their accounts, or any activity conducted through customers’ accounts on lost or misplaced mobile devices that allows unauthorized persons to use services without authorization, or where MobiFone’s system is unlawfully compromised by a third party despite MobiFone having fully implemented measures to protect the system (except where caused by MobiFone’s fault).

b) Once having accepted all terms and conditions of this Policy, in accordance with applicable laws and contracts, or when agreeing to permit the processing of their personal data, customers are responsible for providing MobiFone with complete and accurate customer information as requested and for immediately notifying MobiFone upon discovering any violation of regulations on customer information protection.

c) Customers are responsible for respecting the customer information of other data subjects and complying with laws on customer information protection, as well as participating in the prevention and combat of violations of regulations on customer information protection.

d) Customers must not hinder or obstruct the exercise of the legal rights and obligations of the personal data controller, personal data controller and processor, or personal data processor.

e) Customers must not infringe upon the lawful rights and interests of the State, agencies, organizations, or other individuals.

f) Customers shall comply with applicable laws and fulfill their obligations under contracts. The exercise of customers’ rights and performance of obligations must be for the purpose of protecting their own lawful rights and interests.

g) Customers are strictly prohibited from using another person’s personal data or allowing another person to use their personal data to conduct unlawful activities as prescribed by law.

h) Customers shall comply with the principles prescribed in the Law on Personal Data Protection and relevant guiding, amended, supplemented, or replaced legal documents when exercising their rights and performing their obligations.


Article 9. Storage of Customer Information

1. Location for storing customer information

To the extent permitted by law, MobiFone may store customer information in Vietnam and on cloud computing storage solutions.

MobiFone applies data security standards in accordance with applicable laws.

The transfer of customer information abroad must comply with Vietnamese laws on personal data protection applicable from time to time.

2. Customer information retention period

Unless otherwise provided by law, MobiFone shall only retain customer information for the purpose of fulfilling mandatory purposes and other purposes that are not prohibited by law and to which the customer has consented as specified in this Policy.


Article 10. Obligations of MobiFone

1. Customer information shall be kept confidential in accordance with applicable laws and MobiFone’s Customer Information Protection Policy.

MobiFone shall implement measures to protect customer information in accordance with applicable laws, including measures to prevent the following acts:

a) Theft of or unauthorized access to information.

b) Unauthorized use of information.

c) Unauthorized modification, updating, or deletion of information.

2. MobiFone applies physical, electronic, and administrative measures to protect customer information, including:

a) Official information systems and websites of MobiFone containing customer information are protected by security measures and technologies such as firewalls, encryption, and intrusion prevention; MobiFone establishes personnel controls and inspection, assessment, and review procedures to prevent violations of regulations on customer information protection.

b) MobiFone shall take all necessary measures to ensure that customers’ customer information is processed for the purposes notified to and consented to by customers. MobiFone shall always comply with legal requirements relating to the processing of customer information.

3. MobiFone shall fulfill customers’ requests relating to their personal data, provided that such requests comply with applicable laws.

For requests for consent to process sensitive personal data, the data subject must be informed that the data to be processed constitutes sensitive personal data (under Clause 4, Article 6 of Decree No. 356/2025/ND-CP).

4. In the event that an information system is attacked, creating a risk to the safety and security of customer information, MobiFone or the relevant information storage provider must notify the competent state management authority within the period prescribed by law and implement necessary measures to ensure the safety and security of customer information in accordance with laws on cybersecurity, network information security, electronic transactions, and other relevant laws.

5. Other obligations under this Policy and applicable laws.


Article 11. Rights of MobiFone

1. Process customers’ personal data strictly in accordance with the purposes, scope, and other contents agreed with or consented to by customers.

2. Amend this Policy from time to time and ensure that customers are notified through MobiFone’s communication channels before such amendments take effect.

3. Refuse unlawful requests made by customers.

4. Not fulfill customers’ requests for deletion or destruction of personal data in cases prescribed by the Law on Personal Data Protection and relevant guiding, amended, supplemented, or replaced legal documents from time to time.

5. Extend the time for processing customers’ requests depending on the nature and complexity of the requests.

6. Decide to apply appropriate measures to protect customers’ personal data.

7. To the extent permitted by law, where a customer requests withdrawal of consent and/or requests MobiFone to delete or restrict the processing of the customer’s personal data, MobiFone has the right to restrict, suspend, or terminate, in whole or in part, the provision of products and services to the customer due to insufficient information and data to provide such products and services; the customer shall bear responsibility for all consequences and damages that may arise, and MobiFone shall not be liable for any loss incurred by the customer in such case.

8. Other rights in accordance with MobiFone’s internal regulations and relevant laws from time to time.


Article 12. Consequences, Unintended Damages and Potential Risks

1. MobiFone uses various information security measures and technologies to protect customers’ customer information from unintended use or disclosure during the processing of customer information (including customers’ biometric data).

MobiFone is committed to maintaining the highest level of confidentiality for customer information.

Some unintended consequences, damages, and risks that may occur include:

a) Hardware or software errors during the processing of customer information that unintentionally affect customer information (including errors, damage, or loss).

b) Security vulnerabilities beyond MobiFone’s control, or systems being attacked by hackers, resulting in the disclosure or leakage of customer information.

c) Customers themselves causing information leakage due to carelessness or fraud; accessing websites/downloading service-providing applications containing malicious software; or voluntarily sharing information with others.

2. MobiFone recommends that customers strictly comply with their responsibilities for protecting customer information as specified in Article 8 of this Policy and applicable laws.

3. In the event of hardware or software errors during the processing of customer information as specified in Point a, Clause 1 of this Article, MobiFone shall promptly take corrective measures to minimize customer damages and provide compensation (if any) as stipulated in the Contract or in accordance with applicable laws.


Article 13. Protection of Personal Data of Children, Persons with Lost or Limited Civil Capacity, and Persons with Difficulties in Cognition and Behavioral Control

1. In the course of providing products, goods, and services, MobiFone may have customers who are individuals aged from 7 (seven) years to under 16 (sixteen) years (“Child Customers”).

MobiFone shall carry out necessary procedures to verify the age of Child Customers before processing their personal data.

2. Where a Child Customer purchases, registers for, or uses products, goods, or services, MobiFone shall obtain confirmation evidencing consent to the processing of personal data from the Child Customer and the child’s parent or guardian in accordance with applicable laws from time to time.

3. MobiFone shall cease processing the personal data of children, persons with lost or limited civil capacity, and persons with difficulties in cognition and behavioral control in the following cases:

a) The person who provided consent as specified in Clause 1 of this Article withdraws consent to the processing of personal data of the child, person with lost or limited civil capacity, or person with difficulties in cognition and behavioral control, except where otherwise provided by law.

b) At the request of a competent authority where there are sufficient grounds to establish that the processing of personal data may infringe upon the lawful rights and interests of the child, person with lost or limited civil capacity, or person with difficulties in cognition and behavioral control, except where otherwise provided by law.


Article 14. Protection of Personal Data in Big Data, Artificial Intelligence, Blockchain, Metaverse, and Cloud Computing

MobiFone protects personal data in the processing of big data, artificial intelligence, blockchain, metaverse, and cloud computing in compliance with the Law on Personal Data Protection and other laws, regulations, guidance, amendments, and supplements applicable from time to time.


Article 15. Protection of Personal Data in Relation to Biometric Data
